This Legal Notice provides mandatory disclosures required under Dutch and European Union law, including the Dutch Civil Code (Burgerlijk Wetboek), the EU General Data Protection Regulation (GDPR), the EU Digital Services Act (DSA), the EU AI Act, and applicable consumer protection legislation. By accessing or using wowstore.live (the "Platform"), you acknowledge that you have read and understood this Legal Notice.

2. Data Controller Information (GDPR)

Pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (General Data Protection Regulation), the following data controller information is provided:

2.1 Your Data Protection Rights

Under the GDPR, you have the following rights with respect to your personal data:

  • Right of Access (Article 15) — Obtain confirmation of whether your data is being processed and receive a copy.
  • Right to Rectification (Article 16) — Request correction of inaccurate personal data.
  • Right to Erasure (Article 17) — Request deletion of your personal data ("right to be forgotten").
  • Right to Restriction of Processing (Article 18) — Request limitation of processing under certain conditions.
  • Right to Data Portability (Article 20) — Receive your data in a structured, machine-readable format.
  • Right to Object (Article 21) — Object to processing based on legitimate interests or direct marketing.
  • Right Not to Be Subject to Automated Decision-Making (Article 22) — Right not to be subject to decisions based solely on automated processing, including profiling.

To exercise any of these rights, submit your request to privacy@wowstore.live. We will respond within thirty (30) days as required by law. If you are not satisfied with our response, you have the right to lodge a complaint with the Autoriteit Persoonsgegevens (Dutch Data Protection Authority) at autoriteitpersoonsgegevens.nl.

3. AI Services Disclosure

In compliance with Regulation (EU) 2024/1689 (EU AI Act) and the principle of transparency, Wow Store-nl discloses that this Platform integrates artificial intelligence technologies across multiple features. Users interacting with AI-powered features should understand the nature, purpose, and limitations of these services.

3.1 AI Design Studio (AI Creative Studio)

The Platform provides AI-powered image generation capabilities, including but not limited to:

  • Image Generation: Powered by FAL.ai infrastructure, FLUX models, and proprietary self-hosted Z-Image models.
  • Purpose: Enables users to create custom designs for print-on-demand products.
  • Disclosure: All images produced through the AI Design Studio are generated by artificial intelligence. Results are non-deterministic and may vary between sessions. Generated images may contain artifacts, inconsistencies, or unintended visual elements.

3.2 Video Generation

  • Technology: Kling 3.0, operated through FAL.ai infrastructure.
  • Purpose: Allows users to create AI-generated video content for product visualization and marketing.
  • Disclosure: AI-generated videos are synthetic media. They may not perfectly represent physical products. Video output quality and consistency may vary.

3.3 Virtual Try-On

  • Technology: AI image-to-image processing.
  • Purpose: Enables users to visualize how products (such as apparel) may appear when worn.
  • Disclosure: Virtual try-on results are AI-generated approximations. Actual product appearance, fit, color, and texture may differ significantly from the virtual representation. Virtual try-on images should not be relied upon as an accurate depiction of the final product.

3.4 Lucy AI Assistant

  • Purpose: AI-powered conversational assistant providing customer support, design recommendations, product suggestions, and general Platform guidance.
  • Disclosure: Lucy is an artificial intelligence system, not a human agent. Responses generated by Lucy are algorithmically produced and may not always be accurate, complete, or applicable to your specific situation. Lucy may reference products, features, or policies; users should verify critical information independently or contact our human support team.

3.5 AI-Generated Product Recommendations

The Platform may use algorithmic and AI-driven systems to provide personalized product recommendations. These recommendations are based on browsing behavior, purchase history, and algorithmic profiling. In accordance with Article 22 of the GDPR, you may object to profiling-based recommendations by contacting privacy@wowstore.live.

3.6 General AI Disclaimer

AI-generated content on this Platform (images, videos, text, and recommendations) is produced by machine learning models and does not constitute professional advice. Wow Store-nl does not guarantee the accuracy, completeness, safety, or suitability of any AI-generated output. Users are solely responsible for reviewing AI-generated content before use. AI-generated content may inadvertently resemble existing copyrighted material, trademarks, or real persons; users must ensure that their use of AI-generated content complies with applicable laws.

3.7 TikTok Integration (AI Creative Studio)

The AI Design Studio (referred to as "AI Creative Studio" on TikTok) is integrated with TikTok to enable content sharing and social commerce. This integration uses:

  • TikTok Login Kit: For secure OAuth authentication, accessing basic profile information (display name, avatar) via the user.info.basic scope.
  • TikTok Content Posting API: For sharing AI-generated designs and videos to TikTok with user consent via the video.upload scope.

Use of TikTok integration is subject to TikTok's own Terms of Service and Privacy Policy. Wow Store-nl is not responsible for TikTok's data practices.

4. Token and Credit Economy

The Platform offers a digital credit and token system ("Credits" or "Tokens") that enables access to premium AI features and services.

  • Nature: Credits and Tokens are digital units of exchange valid exclusively within the wowstore.live Platform. They are not currency, securities, investment instruments, or stored-value instruments under Directive 2009/110/EC.
  • Non-Refundable: Once purchased, Credits and Tokens are non-refundable except as required by mandatory applicable law. This does not affect your statutory withdrawal rights as outlined in Section 10 of this Legal Notice.
  • No Cash Value: Credits and Tokens carry no monetary value outside the Platform and cannot be exchanged, transferred, or redeemed for cash, fiat currency, cryptocurrency, or any other form of monetary consideration.
  • Expiration: Credits and Tokens may be subject to expiration or modification. Users will be notified of any material changes to the credit system with reasonable advance notice.
  • Non-Transferable: Credits and Tokens are bound to the purchasing account and may not be transferred to other users or accounts unless explicitly permitted by the Platform.

5. Print-on-Demand Disclosure

Wow Store-nl operates a print-on-demand (POD) business model. It is important that customers understand the following:

5.1 Manufacturing and Fulfillment

  • Physical products listed on this Platform are manufactured by third-party print-on-demand and fulfillment partners, including but not limited to Zendrop, Printful, Printify, and Gelato.
  • Wow Store-nl does not directly manufacture, warehouse, or ship physical products. Production, quality control, and shipping are managed by our fulfillment partners in accordance with their respective operational standards.
  • Shipping times, carrier selection, and delivery schedules are determined by the fulfillment partner and the shipping method selected at checkout.

5.2 Product Variations

  • Color Accuracy: Colors displayed on screen may differ from the final printed product due to variations in screen calibration, printing technology, substrate materials, and production conditions. Such variations are inherent to the print-on-demand process and do not constitute a defect.
  • Sizing and Placement: Minor variations in print placement, sizing, and alignment may occur between production runs and across different fulfillment partners.
  • Materials: Product materials (e.g., fabric weight, paper quality) may vary slightly between batches and suppliers.

5.3 Custom and Personalized Products

Products that are custom-made, personalized, or produced using user-uploaded or AI-generated designs are exempt from the EU right of withdrawal under Article 16(c) of Directive 2011/83/EU, unless the product is defective or does not match the order. See Section 10 for full consumer rights information.

6. Intellectual Property

6.1 Platform Intellectual Property

All content, software, technology, branding, trademarks, trade names, logos, UI/UX design, and proprietary systems on the Platform (including but not limited to the Wow Store brand, Lucy AI, the AI Design Studio, Z-Image models, and the etonomous.ai ecosystem) are the intellectual property of Wow Store-nl or its licensors and are protected by Dutch, EU, and international intellectual property laws. Unauthorized reproduction, distribution, modification, or commercial exploitation is strictly prohibited.

6.2 User Content License

By uploading, submitting, or creating content on the Platform (including designs, images, text, and other materials), you grant Wow Store-nl a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute such content solely for the purposes of operating the Platform, fulfilling orders, and providing services. You retain ownership of your original content, subject to the license granted herein.

6.3 AI-Generated Content Ownership

Ownership and usage rights of AI-generated content are subject to the following:

  • Content generated by AI tools on the Platform using your inputs and creative direction is provided to you for personal and commercial use, subject to the Platform's Terms of Service.
  • Wow Store-nl does not claim exclusive ownership of AI-generated outputs created at your direction; however, we retain a license to use anonymized and aggregated outputs for model improvement and Platform enhancement.
  • AI-generated content may not be protected by copyright in all jurisdictions. Users are responsible for determining the intellectual property status of AI-generated content under their local laws.
  • Users warrant that their input prompts and uploaded materials do not infringe upon the intellectual property rights of any third party.

7. Third-Party Services

The Platform integrates with and relies upon various third-party service providers. Wow Store-nl is not responsible for the practices, policies, uptime, or content of third-party services. Use of third-party services is subject to their respective terms and privacy policies.

  • E-Commerce Platform: Shopify Inc. — hosting, checkout, payment processing infrastructure.
  • AI Infrastructure: FAL.ai — AI model hosting and inference for image generation, video generation, and related AI services.
  • Social Commerce: TikTok (ByteDance) — AI Creative Studio integration, content sharing, social commerce via Login Kit and Content Posting API.
  • Fulfillment Partners: Zendrop, Printful, Printify, Gelato — product manufacturing, printing, and shipping.
  • Payment Processors: Payments are processed through Shopify Payments and/or third-party payment gateways (e.g., Stripe, PayPal, iDEAL, Bancontact, and other local EU payment methods). Wow Store-nl does not directly store credit card information.
  • Shipping Carriers: Various international and domestic carriers as selected by the fulfillment partner or the customer at checkout.
  • Analytics and Marketing: The Platform may use analytics, marketing, and advertising services provided by third parties. See Section 13 (Cookie & Tracking Notice) for further details.

Links to third-party websites or services appearing on the Platform are provided for convenience only and do not constitute endorsement by Wow Store-nl. We are not responsible for the content, accuracy, or availability of linked third-party sites.

8. The 1% Movement — Social Impact Commitment

Wow Store-nl is committed to positive social and environmental impact through "The 1% Movement," an initiative through which the company aspires to allocate a portion of revenue or resources toward charitable, social, or environmental causes.

  • Aspirational Nature: The 1% Movement is a voluntary, aspirational commitment and may be modified, suspended, or discontinued at the sole discretion of Wow Store-nl.
  • Not a Guarantee: Participation in or promotion of The 1% Movement does not create a contractual obligation, fiduciary duty, or enforceable commitment to any specific person, organization, or cause.
  • Not Securities or Investment: The 1% Movement, and any references thereto, do not constitute securities, investment products, or financial instruments. No returns, dividends, or financial benefits are promised or implied to customers, users, or any third party.
  • Transparency: Wow Store-nl endeavors to publish periodic updates regarding the impact of The 1% Movement, subject to operational feasibility.

9. NFT & Wearability Mining

The Platform may offer or reference experimental features related to non-fungible tokens (NFTs) and a concept referred to as "Wearability Mining."

  • Experimental Nature: NFT and Wearability Mining features are experimental, in development, and subject to change, suspension, or discontinuation at any time without prior notice.
  • No Guaranteed Value: NFTs issued or referenced by the Platform carry no guaranteed monetary value, resale value, or utility beyond what is explicitly stated at the time of issuance. Digital assets may lose all value.
  • Not Financial Products: NFTs and tokens associated with Wearability Mining are not securities, investment contracts, commodities, or financial instruments. They are digital collectibles or utility tokens within the Platform ecosystem only.
  • Regulatory Compliance: Wow Store-nl monitors evolving EU regulations concerning digital assets, including Regulation (EU) 2023/1114 (MiCA). Features may be modified or removed to ensure continued regulatory compliance.
  • User Responsibility: Users are solely responsible for understanding and complying with their local laws regarding the purchase, ownership, and transfer of digital assets, including applicable tax obligations.

10. Consumer Rights (European Union)

As a business established in the European Union, Wow Store-nl respects and upholds consumer rights under EU and Dutch law.

10.1 Right of Withdrawal (14-Day Cooling-Off Period)

In accordance with Directive 2011/83/EU and Title 5, Section 2a of the Dutch Civil Code (Koop op Afstand), you have the right to withdraw from a purchase within fourteen (14) calendar days from the day you receive the goods, without providing any reason.

To exercise your right of withdrawal, you must notify us by a clear statement (e.g., email to support@wowstore.live) before the expiration of the withdrawal period. You must return the goods without undue delay and in any event no later than fourteen (14) days from the day on which you communicate your withdrawal. You bear the direct cost of returning the goods.

Exceptions to the Right of Withdrawal:

  • Custom-made or personalized products (Article 16(c) of Directive 2011/83/EU).
  • Digital content (including AI Credits and Tokens) where performance has begun with your prior express consent and acknowledgment that you lose your right of withdrawal (Article 16(m)).
  • Sealed goods that are not suitable for return due to health or hygiene reasons, if unsealed after delivery (Article 16(e)).

10.2 Legal Guarantee of Conformity

Under EU consumer law, all physical goods benefit from a minimum two-year legal guarantee of conformity from the date of delivery. If a product is defective or does not conform to the contract, you are entitled to repair, replacement, a price reduction, or a full refund in accordance with Directive (EU) 2019/771.

10.4 Supervisory Authority

If you believe your data protection rights have been violated, you have the right to lodge a complaint with the Autoriteit Persoonsgegevens (Dutch Data Protection Authority):

11. Liability Limitations

To the fullest extent permitted by applicable Dutch and EU law:

11.1 AI Content Disclaimer

Wow Store-nl provides AI tools and outputs on an "as is" and "as available" basis. We do not warrant that AI-generated content will be accurate, error-free, safe, non-infringing, or suitable for any particular purpose. Users assume all risk associated with the use of AI-generated content. Wow Store-nl shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of AI-generated content.

11.2 Print-on-Demand Variations

Wow Store-nl is not liable for minor variations in color, sizing, placement, or materials inherent to the print-on-demand production process that fall within industry-standard tolerances. Claims for genuinely defective products are handled in accordance with Section 10.2.

11.3 Service Availability

Wow Store-nl does not guarantee uninterrupted, error-free, or secure access to the Platform or any of its features. The Platform may be subject to scheduled maintenance, unplanned outages, or disruptions caused by third-party service providers. We shall not be liable for any loss or damage arising from service unavailability.

11.4 Third-Party Actions

Wow Store-nl is not liable for acts, omissions, delays, or failures of third-party service providers, including but not limited to fulfillment partners, shipping carriers, payment processors, and AI infrastructure providers.

11.5 Maximum Liability

To the extent permitted by applicable law, the total aggregate liability of Wow Store-nl for any and all claims arising from or relating to the use of the Platform shall not exceed the amount actually paid by you to Wow Store-nl in the twelve (12) months preceding the event giving rise to the claim. Nothing in this Legal Notice excludes or limits liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded or limited under Dutch or EU law.

12. Dispute Resolution

12.1 Governing Law

This Legal Notice and any disputes arising from or relating to the use of the Platform shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Mandatory consumer protection laws of your country of residence shall apply where required by EU law.

12.2 Jurisdiction

Any disputes that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands, subject to the mandatory consumer forum rules of Regulation (EU) No 1215/2012 (Brussels I Recast), which may entitle you to bring proceedings in the courts of your country of residence.

12.3 EU Online Dispute Resolution (ODR)

In accordance with Regulation (EU) No 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform for consumers who wish to resolve disputes arising from online purchases without going to court:

12.4 Alternative Dispute Resolution

We are committed to resolving disputes fairly and efficiently. If a dispute cannot be resolved through direct communication, we may agree to participate in mediation or another alternative dispute resolution procedure.

13. Cookie & Tracking Notice

In compliance with Directive 2002/58/EC (ePrivacy Directive), as implemented in the Dutch Telecommunications Act (Telecommunicatiewet), and the GDPR:

  • Essential Cookies: The Platform uses strictly necessary cookies to ensure basic functionality, security, and session management. These cookies do not require consent.
  • Analytics Cookies: We may use analytics tools to understand how visitors interact with the Platform. Analytics cookies are placed only with your prior consent.
  • Marketing and Advertising Cookies: Third-party cookies for advertising, retargeting, and marketing purposes are placed only with your explicit consent.
  • Consent Management: Upon your first visit, you will be presented with a cookie consent mechanism that allows you to accept or decline non-essential cookies. You may withdraw or modify your consent at any time through the cookie settings on the Platform.
  • Third-Party Tracking: Certain third-party services integrated into the Platform (e.g., Shopify analytics, payment processors, social media widgets) may set their own cookies. Please refer to the privacy policies of those third parties for information about their tracking practices.

14. Age Requirement

The Platform and its services are intended for individuals who meet the following age requirements:

  • General Use: You must be at least eighteen (18) years of age or the age of legal majority in your jurisdiction (whichever is higher) to create an account, make purchases, or use AI-powered features on the Platform.
  • Minors (16+): Individuals aged sixteen (16) and older may access certain features of the Platform with verifiable consent from a parent or legal guardian, in accordance with Article 8 of the GDPR and Article 4:234 of the Dutch Civil Code.
  • Under 16: Individuals under the age of sixteen (16) are not permitted to use the Platform. Wow Store-nl does not knowingly collect personal data from children under the age of sixteen. If we become aware that we have collected data from a child under 16 without appropriate parental consent, we will take steps to delete such data promptly.

16. Amendments

We encourage users to review this Legal Notice periodically.

17. Severability

If any provision of this Legal Notice is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Language

This Legal Notice is drafted in English. In the event of any discrepancy between a translated version and the English original, the English version shall prevail, unless otherwise required by applicable local law.
